The “Short Sale” Process
The short sale process has a reputation of being anything but short. There are many reasons for this stigma that has been placed on short sales. We let our experience dealing with these cases minimize the amount of stress on the homeowner. Although there are many reasons for short sales having a high failure rate we feel that lack of experience is the main culprit. An experienced Real Estate agent is a critical part of the process in order to successfully list and advertise your property, but they should not be relied upon to negotiate your short sale. Only an attorney has an ethical obligation to represent only your best interests.
How do we assist you with the short sale process?
- We make contact with the lender to inform them that you are requesting a short sale.
- We prepare a comprehensive short sale package for delivery to submit to the lender on your behalf making a case for why you should be considered for a short sale.
- We assist in the preparation of the financial statement of the homeowner.
- We assist in the preparation of the financial hardship letter.
- If no real estate broker is under agreement with the homeowner, we assist in finding a real estate broker that specializes in short sales and has ample experience in this area.
- When a short sale contract is accepted by the lender, we will act as the closing agent to be certain that the short sale and contract are followed. Having the ability to act as the closing agent has enabled us to have a higher rate of success bringing short sale transactions to close.
- We will negotiate on your behalf regarding all liens on the property. This may include mortgage liens, tax liens, utility liens and HOA/COA liens.
